Maintenance & Financial Responsibilities

Property in the association falls into three broad categories.

  • The Unit

  • Common Elements, and

  • Limited Common Elements

The Unit is defined by the declaration and real estate title and is owned by the Unit owner. The Unit owner is solely responsible for the maintenance, repair, and upkeep of their Unit.

All other property covered by the declaration is a Common Element with ownership shared equally by all Unit owners and managed by the Association. The Association is responsible for maintaining, repairing, and replacing all Common Elements. The costs associated with Common Elements are a Common Expense shared jointly by all Unit owners.

A Limited Common Element is a portion of the common elements allocated for the exclusive use of one or more but fewer than all of the units. Like other common elements, a Limited Common Element is owned by the Association membership. Still, unlike Common Elements, the right to use a Limited Common Element is restricted to the assigned owner(s). Limited Common Elements are defined individually in the Declaration. The costs associated with Limited Common Elements are always assessed to the individual Unit Owner(s) assigned to that element.

Common Areas

No permanent or semi-permanent items, including furniture, structures, or outdoor appliances, are permitted in Common Areas.

Landscaping, maintenance, changes, or additions in Common Areas are the sole responsibility of the Association. Requests for maintenance, changes, or additions to these areas should be submitted via the maintenance request form on the website.

Temporary, seasonal, and decorative garden objects, such as a limited number of potted plants or small garden flags, may be placed in Common Areas provided they are maintained in good condition and do not obstruct the landscapers working in those areas. Seasonal decorations should be confined to Limited Common Areas such as porches or courtyards and be removed promptly following the end of the seasonal period.

Items placed in Common Areas are done so at the owner's risk, and the Association takes no responsibility for damage or loss of these items, which are subject to removal at any time.

Governing Documents

Property in Oakmont II is bound to the following governing documents in descending order of authority.

Declaration of Covenants, Conditions, and Restrictions, or “CC&Rs”

The Declaration of Covenants, Conditions and Restrictions, or “CC&Rs,” is the primary and most important governing document for a condominium or planned development and is required for all condominiums and planned developments. It is recorded in the county records so that it automatically binds each person who becomes an owner of a lot or condominium (meaning that it does not need to be signed by a new owner).

The Declaration establishes the authority of an owners association to control the property and collect dues.

By-Laws

The Bylaws of a condominium or planned development contain the operating procedures of the homeowners association. These generally include how to call and conduct a meeting, how to vote, how to levy assessments, how to manage association business, and how to keep records. In Oakmont II, the Bylaws also establish conditions and requirements for leasing Units.

All owners should have received a copy of the governing documents when purchasing their property. Official copies are available from the Dauphin County Recorder of Deeds.

Be sure to reference Oakmont 2 when making this request. Paint colors MAY be different from other associations within Oakmont and/or what may be pre-existing.

Owners are responsible to ensure color matching to these formulas if purchasing from another retailer.

Architectural Standards and Specifications

The architectural criteria and standards were adopted shortly after construction and not reviewed recently. This document is being made available as a reference, however, portions of it may be superseded by other documents. In particular, the paint specifications in this document have been replaced with the newer version above.
